Agreement to these terms
These Terms of Service (the “Terms”) form a binding agreement between you and Kzanected (“Kzanected,” “we,” “us” or “our”) regarding your access to and use of Kzanected VC, including the website at vc.kzanected.com, your account dashboard, public profile pages, contact downloads and any related services (together, the “Service”).
By creating an account, checking the acceptance box at sign-up, or otherwise using the Service, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company or other organization, you represent that you are authorized to accept these Terms on its behalf, and “you” refers to that organization as well.
If you do not agree to these Terms, do not use the Service.
The Service
Kzanected VC lets you create and manage a digital business card: a public profile page at a unique address (for example, vc.kzanected.com/yourname) that can display your name, photo or logo, professional details, contact information and links. You can share that address directly, through a QR code, or by programming it into an NFC card or tag. Visitors can contact you and download your details as a standard contact file (vCard / VCF).
We continuously improve the Service and may add, change or remove features from time to time. Where a change materially reduces core functionality you rely on, we will make reasonable efforts to give you advance notice.
Eligibility and your account
- Age. You must be at least 18 years old, or the age of legal majority where you live if that is higher, to create an account.
- Accurate information. You agree to provide a valid email address that you control and to keep your account information accurate and up to date.
- Security. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at accounts@vc.kzanected.com if you suspect unauthorized access. We may temporarily lock an account after repeated failed sign-in attempts or end inactive sessions to protect it.
- Email verification. We may require you to verify your email address and may limit features until you do.
- One card per account. Each account includes one public profile. You may not create accounts by automated means or use another person’s account without permission.
Your card and your content
You own your content. You retain all rights to the information, text, photos, logos and links you add to the Service (“Your Content”).
License to us. You grant Kzanected a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display and distribute Your Content solely as needed to operate, secure and improve the Service — for example, to show your public card, resize your photo and generate your contact file. This license ends when Your Content is deleted from the Service, except for copies we must retain for legal or security reasons.
Your card is public. Whatever you publish on your card can be viewed, saved and shared by anyone who has your link, QR code or NFC card, and may be indexed by search engines. Do not publish information you want to keep private. You can hide your email or phone number, disable contact downloads, or switch your card off at any time from your dashboard.
Your responsibility. You are solely responsible for Your Content and represent that you have all rights necessary to publish it, and that it is accurate and does not violate these Terms or the rights of any third party.
Usernames. Your public address is first-come, first-served. Certain names are reserved by Kzanected. We may reclaim or change a username that impersonates another person or brand, infringes a trademark, is misleading, or violates these Terms. If you change your username yourself, links, QR codes and NFC cards that use the previous address may stop working; Kzanected is not responsible for reprinting or reprogramming them.
Physical NFC cards and Quick Setup
Physical cards. Kzanected may offer physical PVC business cards with an NFC chip and a QR code (“Physical Cards”). Physical Cards are sold, printed and programmed in person, for example at our booth during events. The price and payment are agreed and handled at the point of sale; Kzanected VC does not process payments for Physical Cards.
Your design. You can design how your Physical Card looks by choosing a style, colors and which details from your profile appear on it. We print the design you approve. Because colors and details may vary slightly between screens and printed PVC, small differences in color or position are not defects. Please review your name, title, contact details and card address before printing. If you add a logo, you confirm you have the right to use it; we may decline to print logos or designs that infringe someone else’s rights or break these Terms.
Statistics. Kzanected counts card visits anonymously to operate and improve the Service (see our Privacy Policy). These numbers are approximate — some phones and apps open links automatically or block counting — and are provided for information only.
Card address and what a tap does. Each Physical Card is programmed with, and its QR code points to, your public card address (for example, vc.kzanected.com/yourname). Once a Physical Card has been delivered, that address is locked so the card keeps working; contact us at accounts@vc.kzanected.com if you need help. You can change what happens when someone taps or scans your card at any time from your account — show your profile, open a link you choose, download your contact, or start a WhatsApp chat or text message to the number you provide. You are responsible for the destinations and numbers you choose; the acceptable-use rules below apply to them.
Quick Setup at events. At events we may offer a short Quick Setup on a phone or tablet that creates your account and card with basic information. When you use it you confirm you meet the age requirement and accept these Terms and our Privacy Policy. We then email you a single-use activation link to create your password; until you activate it, you cannot sign in to the account. If an email address already has an account, Quick Setup will not change that account unless you sign in.
Compatibility. NFC and QR reading depends on the visitor’s phone, its settings and apps. Phones without NFC can scan the QR code instead. Physical Cards are not covered by any warranty beyond what is required by law or what we offer in writing at the time of sale.
Acceptable use
You agree not to use the Service, or allow others to use your card, to:
- impersonate any person or organization, or misrepresent your identity, title or affiliation;
- publish content that is unlawful, defamatory, fraudulent, harassing, hateful, sexually explicit or that promotes violence;
- link to phishing pages, malware, scams or other deceptive or harmful destinations;
- infringe any copyright, trademark, privacy or publicity right;
- send spam or use contact details obtained through the Service for unsolicited bulk messaging;
- probe, scan or test the vulnerability of the Service, bypass any security measure, or access accounts or data that are not yours;
- scrape, crawl or harvest data from the Service by automated means, other than standard search-engine indexing of public cards;
- interfere with or overload the Service, or resell or sublicense it without our written permission.
We may remove content or disable links that we reasonably believe violate these Terms.
Plans, payments and Premium
Basic (free). The Basic plan is free and has no time limit. It includes your public card, QR code, contact download and the features described on our Pricing page, with the limits shown there (for example, the number of links and colors).
Premium. Premium is a paid plan that adds the features listed on the Pricing page. Premium is purchased for a set period (for example, one month or one year) and does not renew or charge you automatically. Prices are shown on the Pricing page and at the point of sale before you pay. We may change prices for future purchases; a change never affects a period you have already paid for.
Payment. At this time payments are made in person or by arrangement with us (for example, cash or a card or bank payment through our banking provider). Online payments may be offered later. We record the date, amount, method and period of each payment; we never store full card numbers. Refund requests are handled case by case — contact us at accounts@vc.kzanected.com.
When Premium ends. Your account moves to the Basic plan. Your card and its address keep working. Premium settings you already use stay as they are — for example, what your card opens when tapped or scanned, or links and colors you added — but you cannot add or change Premium features until you renew. We will try to remind you by e-mail before your Premium period ends.
Founding members. Accounts that receive founding-member status (for example, by signing up with a founder code) receive Premium at no cost until October 31, 2027, and then the Basic plan. Promotional access has no cash value, is non-transferable and may be limited to a number of spots.
Suspension and termination
By you. You may stop using the Service at any time. To permanently close your account, email accounts@vc.kzanected.com from your registered address. Deleting your account permanently removes your profile, links and photo, and your public address stops working.
By us. We may suspend or terminate your access, or unpublish your card, if you breach these Terms, if required by law, if your use creates risk or possible legal exposure for Kzanected or others, or if we discontinue the Service. Where reasonable, we will notify you and give you an opportunity to fix the issue first. If we discontinue the Service as a whole, we will give at least 30 days’ notice.
Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification and governing law — will survive.
Third-party links and services
Cards on the Service may link to websites and services we do not control, such as social networks, messaging apps (including WhatsApp and text messaging), or booking tools. If you set your card to open one of them, visitors are sent there directly. We are not responsible for their content, availability or practices, and your use of them is governed by their own terms. Opening links and saving contacts happens on your or your visitors’ devices and apps.
Our intellectual property
The Service, including its software, design, templates, text, graphics and the Kzanected and Kzanected VC names and logos, is owned by Kzanected or its licensors and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not copy, modify, reverse engineer or create derivative works of the Service, or use our trademarks without our prior written consent.
If you send us feedback or suggestions, you allow us to use them without restriction or compensation.
Disclaimers
We work hard to keep the Service fast, secure and available, but it is provided “as is” and “as available.” To the fullest extent permitted by law, Kzanected disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that cards will display identically on every device or app, or that every phone will read every NFC card or QR code.
You are responsible for keeping your own copy of any information that is important to you.
Limitation of liability
To the fullest extent permitted by law, Kzanected and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business opportunities, goodwill or data, arising out of or related to your use of, or inability to use, the Service.
Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (US $50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
Indemnification
You agree to defend, indemnify and hold harmless Kzanected and its owners and employees from any claims, damages, losses and expenses (including reasonable attorneys’ fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
Governing law and disputes
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at accounts@vc.kzanected.com and try to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Wayne County, Michigan, and you and Kzanected consent to their jurisdiction. Either party may bring an individual claim in small-claims court where eligible.
Changes to these terms
We may update these Terms as the Service evolves. If a change is material, we will notify you by email or through the Service at least 15 days before it takes effect, unless the change is required by law or addresses a security issue. The “Effective” date above shows when these Terms were last updated. Continuing to use the Service after changes take effect means you accept the updated Terms.
General
These Terms and our Privacy Policy are the entire agreement between you and Kzanected regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Notices to you may be sent to the email address on your account.
